These Terms of Service (“Terms”) govern your use of the website and services provided by Simple Path Media (“we,” “us,” or “our”) at simplepathmedia.com. By accessing our website or engaging our services, you agree to these Terms.

Services

Simple Path Media provides website design, landing page development, marketing automation, and workflow automation services for small businesses. The specific scope, deliverables, timeline, and pricing for any engagement are defined in a separate proposal or agreement provided before work begins.

Use of This Website

You agree to use this website for lawful purposes only. You may not use the site in any way that could damage, disable, or impair its functionality, or interfere with any other party’s use of the site.

Contact Form and Communications

When you submit our contact form, you provide your name, email address, and optional business details so we can respond to your inquiry. Submitting the form does not create a binding agreement or obligation for either party. It is simply a request for information or a conversation.

SMS/Text Messaging Terms

Program Name: Simple Path Media Transactional Notifications

Program Description:
Simple Path Media sends SMS notifications to two groups:

1. Real estate agents who purchase listing website services through our intake form. Agents receive order confirmation, build status updates, and delivery notifications.
2. Prospective home buyers who submit showing request forms on listing websites we build. Buyers receive a confirmation of their request along with the agent’s contact information.

Additionally, users who check the SMS consent checkbox on our general contact form at simplepathmedia.com may receive responses to their inquiry, project updates, appointment confirmations, and follow-up communications. All messages are transactional.

Consent is not required. You are not required to consent to SMS messaging as a condition of purchasing any services from Simple Path Media.

Message Frequency:
Agents typically receive 2 to 5 messages per order. Buyers typically receive 1 to 2 messages per showing request. General contact form users receive no more than 10 messages per month unless engaged in an active project conversation.

Message and Data Rates:
Standard message and data rates may apply depending on your mobile carrier and plan. Simple Path Media does not charge for the messages themselves.

HELP:
Reply HELP to any message to receive contact information for Simple Path Media support, or contact team@simplepathmedia.com directly.

STOP:
Reply STOP to any message to immediately unsubscribe from further SMS notifications. You will receive one final confirmation message and no further texts will be sent unless you re-opt-in.

Supported Carriers:
Major US carriers are supported, including AT&T, T-Mobile, Verizon, US Cellular, and all major MVNOs. Carriers are not liable for delayed or undelivered messages.

SMS Provider:
We use Twilio to deliver SMS messages. Your phone number is shared with Twilio solely for the purpose of message delivery. See our Privacy Policy for details on how we handle your information.

Project Agreements

Any services engagement (website design, automation builds, consulting, etc.) is governed by a separate proposal, statement of work, or written agreement that outlines scope, deliverables, timeline, payment terms, and revision limits. These Terms of Service do not replace or override the terms of any signed project agreement.

Payment

Payment terms are defined in your project agreement. We use Stripe to process payments. By making a payment, you agree to Stripe’s terms of service. We do not store your credit card information on our servers.

Intellectual Property

All content on this website, including text, design, graphics, and logos, is the property of Simple Path Media unless otherwise stated. You may not copy, reproduce, or distribute any content from this site without written permission.

For client projects, intellectual property ownership and usage rights are defined in your project agreement.

Limitation of Liability

Simple Path Media provides its website and services on an “as is” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Simple Path Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of revenue, data, or business opportunity.

Our total liability for any claim arising from our services shall not exceed the total amount you paid to Simple Path Media for the specific service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Simple Path Media from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our website, your violation of these Terms, or your violation of any third-party rights.

Third-Party Links

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party sites. Linking to a third-party site does not imply endorsement.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in San Diego County, California.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the site after any update constitutes acceptance of the revised Terms.
