These Terms of Service (“Terms”) govern your use of the website and services provided by Simple Path Media (“we,” “us,” or “our”) at simplepathmedia.com. By using this website or engaging our services, you agree to these Terms.

Services

Simple Path Media designs and builds revenue systems for coaches, consultants, and agencies: lead follow-up automation, missed-call text-back, and web design and development. The scope, deliverables, timeline, and pricing for any engagement are defined in a separate proposal or agreement provided before work begins.

Use of this website

You agree to use this website for lawful purposes only. You may not use the site in any way that could damage, disable, or impair it, or interfere with anyone else’s use of it.

Contact form and communications

When you submit our contact form, you provide your name, email address, and optional business details so we can respond. Submitting the form does not create a binding agreement for either party. It is a request for a conversation.

Text messaging terms

Program name: Simple Path Media Transactional Notifications

Program description: Simple Path Media sends text messages in two situations.

1. People who check the SMS consent box on a form at simplepathmedia.com may receive replies to their inquiry, project updates, appointment confirmations, and follow-up.
2. People who contact a client business through a system we run for that business (for example, calling and getting no answer, or submitting a form on their site) may receive follow-up texts from that business through our system.

Consent is not required. You are not required to agree to text messaging as a condition of buying any service from Simple Path Media or from a client business.

Message frequency: Varies by conversation. Follow-up sequences are typically fewer than ten messages over thirty days and stop when you reply or opt out.

Message and data rates: Standard rates may apply depending on your carrier and plan. Simple Path Media does not charge for messages.

HELP: Reply HELP to any message for support contact information, or email jay@simplepathmedia.com.

STOP: Reply STOP to any message to unsubscribe. You will receive one confirmation and no further texts unless you opt in again.

Supported carriers:Major US carriers, including AT&T, T-Mobile, Verizon, US Cellular, and major MVNOs. Carriers are not liable for delayed or undelivered messages.

SMS provider: We use Twilio to deliver text messages. Your phone number is shared with Twilio solely for delivery. See our Privacy Policy for how we handle your information.

Project agreements

Any services engagement is governed by a separate proposal, statement of work, or written agreement covering scope, deliverables, timeline, payment terms, and revision limits. These Terms do not replace or override a signed project agreement.

Payment

Payment terms are defined in your project agreement. We use Stripe to process payments. By paying, you agree to Stripe’s terms of service. We do not store your card details on our servers.

Intellectual property

All content on this website, including text, design, graphics, and logos, belongs to Simple Path Media unless otherwise stated. You may not copy, reproduce, or distribute it without written permission.

For client projects, ownership and usage rights are defined in your project agreement.

Limitation of liability

Simple Path Media provides its website and services on an “as is” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Simple Path Media is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including loss of revenue, data, or business opportunity.

Our total liability for any claim arising from our services will not exceed the amount you paid Simple Path Media for the specific service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Simple Path Media from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our website, your violation of these Terms, or your violation of any third-party rights.

Third-party links

This website may link to third-party sites or services. We are not responsible for their content, privacy practices, or availability. A link is not an endorsement.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Disputes arising from these Terms will be resolved in the courts of San Diego County, California.

We may update these Terms from time to time. The date at the top reflects the most recent revision. Continued use of the site after an update means you accept the revised Terms.
